GENERAL TERMS OF USE

1. PURPOSE OF THE SITE

The site www.vanrycke.com is an e-commerce site accessible via the Internet at the following address: http://www.vanrycke.com. The Vanrycke Site allows Lyie SAS, registered with the Paris Trade Registry under number B 430 269 829 with its head office at 26-28 rue Danielle Casanova - 75002 Paris (hereinafter "Vanrycke") to offer products distributed by Vanrycke (hereinafter the "Vanrycke products") for sale to Internet users browsing the Vanrycke site (hereinafter the "Users").

Use of the Vanrycke Site (hereinafter the "Site") and the purchase of Vanrycke Products (hereinafter the "Products") are subject to these general terms and conditions of the Site (hereinafter the "General Conditions of Use").

When you use the Site, you are bound bty these General Conditions of Use which you are required to respect. Use of the Site also implies acceptance of the Site's security and confidentiality policy (hereinafter the "Security and Confidentiality Policy").

Vanrycke may update these General Conditions of Use at any time. 2. INTELLECTUAL PROPERTY

2.1 Copyright

The Vanrycke Site is fully owned by Vanrycke. The latter holds the intellectual property rights required to put the site online.

While the Site's general structure (graphic guidelines) as well as its context (text, graphics, images), including software, databases and newsletters (hereinafter the "Content") are the property of Vanrycke or third parties authorised to use them and are protected by copyright. Vanrycke grants no licences or other rights other than the right to consult the Site. The reproduction of all or part of the Site and its contents is only permitted for the exclusive purposes of information for personal and private use.

Consequently, in accordance with the provisions of the Intellectual Property Code, any representation, modification, alteration of the Content, by any method and on any media whatsoever, without the express prior authorisation from Vanrycke, is prohibited and constitutes breach of copyright.

Similarly, any unauthorised use of the Site and/or its Content engages the User's criminal and civil liability on the basis of the breach of copyright.

 

2.2 Distinctive signs

The brand, logo, company name, symbol and Vanrycke domain name mentionned on the site constitute distinctive signs which may not be used without express prior permission from their holder. Thus any partial or total representation and/or reproduction and/or use of these distinctive signs is prohibited and constitutes trademark infringement, in application of the provisions of the Intellectual Property Code.

 

2.3 Hypertext links

The hypertext links provided in the Site to other sites, and generally to any resources existing on the Internet, shall not engage Vanrycke's responsibility.

Any creation of links to the Site, any framing of the Site and, more generally, any use of the Content, is subject to prior express authorisation from Vanrycke which may be revoked at any time at the sole dfiscretion of the latter. Vanrycke reserves the right to request the removal of any link to the Site which have not been, or will no longer be, authorised and to request compensation for the damage suffered due to this.

 

3. CONFIDENTIALITY AND SECURITY POLICY OF THE SITES

Respect for privacy is key for Vanrycke. This Policy relating to respect for privacy informs you of the conditions in which your personal information is processed and used.

The Site's Confidentiality and Security Policy governs the use of personal information that you agree to communicate to Vanrycke on the Site. Vanrycke may modify its Confidentiality and Security Policy at any time.

If you decide to use the Site, you agree that Vanrycke collects, uses and discloses information about yourself including personal and financial information in the conditions defined hereinafter.

 

3.1 Information collected

You may use the Site without providing Vanrycke with any personal information. However, it will be nrecessary for you to provide some information, including:

- your name, address, phone number and email address if you wish to receive information from Vanrycke.
- certain financial information (such as your bank card or credit card number) if you decide to buy Products offered on the Site, for the payment of Products ordered and the processing of your order.

The personal data that Varycke collects is collected, processed, saved and stored in accordance with the legal provisions in force in France. Your personal information is kept for 10 years. In terms of banking details, Vanrycke never has access to confidential information relating to the Client's payment method.
Only STRIPE and PAYPAL process this financial transaction and remains in posession of confidential information. You can also send an email at any time requesting that Vanrycke deletes the personal information about you as soon as your order has been processed and delivered. Vanrycke may collect non-personal information on you even if you do not buy any Product on the Site (see "Cookies").

 

3.2 Newsletter

Vanrycke also gives you the option of receiving information that may interest you, including information on the brand and products, by subscribing to the newsletter. If you wish to stop receiving this information, you can click on "Unsubscribe" in the newsletter at any time.

 

3.3 Use of the information collected

Vanrycke may communicate the information you provide on the Site notably to the carrier responsible for delivering your order. Thus, in order to verify information about you, authenticate payments and process orders, Vanrycke may communicate certain financial and other information provided by you to third parties responsible for the provision or credit quality, payment or others.

As Vanrycke does not control the confidentiality policies or parctices of third parties to whom it communicates information on the Site's Users, this Confidentiality and Security Policy does not cover the use or disclosure of this information by these third parties.

3.6 Modifications and updates made to the Confidentiality and security policy

By using the Site, you accept the collection, use and disclosure of your information described in this Confidentiality and Security Policy. In case of modifications or updates, the revised Confidentiality and Security Policy will be put online on the Site with mention of the date of the last update.

 

3.7 Modifications and access to your personal information

Any personal data is subject to the provisions of modified law n° 78-17 of 6th January. Therefore, you have the right to access, rectify or delete data about yourself processed by Vanrycke. If necessary, you should inform Vanrycke of any updates or chnages to your information, including details relating to your postal address and/or email address so we can send your orders to the correct address and contact you about the latter if need be.

 

4. LIMITATION OF LIABILITY

Vanrycke cannot, in any case, be held liable to you or a third party for any indirect, accidental, special or accessory damage - which includes, without this being exhaustive, any loss of earnings or other indirect loss resulting from your use of the Site or your inability to use it, even if Vanrycke has been informed of the possibility of this damage.

 

5. ABSENCE OF GUARANTEE

Vanrycke cannot guarantee that the Site is free from viruses, data deletion programmes or other destruction material and that the information contained on the Site is accurate, complete or up to date.

6. APPLICABLE LAW – DISPUTES

These General Conditions of Use are governed and interpreted in accordance with French law without regard to pronciples of conflicts of laws. These General Conditions of Use are written in French.

In case of dispute, the French courts have exclusive jurisdiction and you agree to accept their exclusive jurisdiction.
